U.S.DepartmentofLaborFf8132015MEMORANDUMFOR:FROM:SUBJECT:OccupationalSafetyandHealthAdministrationWashington,D.C.20210Replytotheattentionof:r:;zAD1i¥~ISTTHOMASGALASSIDIRECTOR,DIRECTORATEOFENFORCEMENTPROG~1tt~JAMESMADDUXrDIRECTOR,DIRECTORAIEOFCONSTRUCTION29CFR1910.269and29CFRPart1926,SubpartV-FallprotectionOnApril11,2014,OSHApromulgatedafinalrulerevising29CFR1910.269and29CFRPart1926,SubpartV,thegeneralindustryandconstructionstandardsforworkonelectricpowergeneration,transmissionanddistributioninstallations.Thismemorandumestablishesenforcementpoliciesforsomeofthefallprotectionrequirementsapplicabletoworkcoveredby29CFR1910.269and29CFRPart1926,SubpartV.ThepoliciesstatedinthismemorandumarebasedonOSHA'sunderstandingofthespecificconditionspresentduringelectricpowergeneration,transmission,anddistributionworkandthusdonotapplytoworkoutsidethescopeof:29-eFR-I-9t0:-269-and-29-eF-R-Part-1-926,-SubpartV.A.FallProtectioninAerialLiftsUnder29CFR1910.269(g)(2)(iv)(C)(l)and29CFR1926.954(b)(3)(iii)(A),employeesworkingfromaerialliftsmustuseeitherafallrestraintsystemorapersonalfallarrestsystem.OSHAisnotawareofanyfallrestraintsystemsavailabletodaythatcanbeusedinabucket-typeaerialliftthatdoesnothaveananchoragebuiltintothebucket.Thus,theAgencyexpectsthatforemployerstomeettherequirementsinthestandards,theywillhaveemployeesworkingfromsuchaerialliftbucketsusingfallarrestequipment.Paragraph(g)(2)(i)of29CFR1910.269andparagraph(b)(1)(i)of29CFR1926.954requirethatpersonalfallarrestsystemsmeettherequirementsofSubpartMofPart1926.Furthermore,29CFR1910.269(g)(2)(iv)(B)and29CFR1926.954(b)(3)(ii)specificallyprovidethatpersonalfallarrestsystemsmustbeusedinaccordancewithsection1926.502(d)inSubpartM,whichspecifies,inpart,thatpersonalfall-1-arrestsystemsmust"beriggedsuchthatanemployeecanneitherfreefallmorethan6feet(1.8m),norcontactanylowerlevel."(See29CFR1926.502(d)(l6)(iii).)OSHArequiresemployerstoensurethatemployeesinaerialliftsarefullyprotectedfromfallswhiletheaerialliftbucketorplatformismovingorinastationarypositionatanyheightatwhichworksubjectto29CPR1910.269or29CFRPart1926,SubpartV,istobeperformed.Exceptasspecificallyprovidedinthefollowingenforcementpolicies,anyfallarrestsystemusedtoprotectemployeesmustcomplyfullywiththerequirementsofSubpartM,includingtherequirement,in29CPR1926.502(d)(l6)(iii),thatthefallarrestsystemberiggedtopreventtheemployeefromcontactinganylowerlevel.Notethatinseparateguidance,OSHAhasclarifiedthattheAgencydoesnottreattreebranchesorutilitylineconductorsorcablesaslowerlevelsforpurposesof29CFR1926.502(d)(l6)(iii).Untilfurthernotice,forworkcoveredby29CPR1910.269and29CPRPart1926,SubpartV,thefollowingenforcementpoliciesapplytoanybucket-typeaerialliftthatdoesnothaveasuitableanchoragebuiltintothebucket.1.Nocitationwillbeissuedunder29CFR1910.269,29CFRPart1926,SubpartV,or29CFR1926.502(d)(16)(iii),becauseafallarrestsystembeingusedbyanemployeeinabucket-typeaerialliftcouldpermittheemployeetocontactalowerlevelwhilethebucketisascendingfromthecradlepositiontoaworkinglevelordescendingfromaworkingleveltothecradlepositionprovided:a)Thefallarrestsystemcompliesinallotherrespectswith29CFRPart1926,SubpartM;andb)Theaerialliftisparkedwiththebrakessetandwiththeoutriggersextendedasrequiredby29CFR1910.269(p)(2)and29CFR1926.959(b);andc)Theemployerhastakenreasonableprecautionstoaddressanyejectionhazardspresentthatco...
