RevisedJuly22,2013InterpretationsfortheInspectionofTemporaryLaborCampsINTERPRETATIONSFORTHEINPECTIONOFTEMPORARYLABORCAMPSPURSUANTTO29CFR1910.142andN.C.GEN.STAT.§§95-222and95-229STANDARD–29CFR1910.142...INTERPRETATION–29CFR1910.142...(a)Site(a)(1)Allsitesusedforcampsshallbeadequatelydrained.Theyshallnotbesubjecttoperiodicflooding,norlocatedwithin200feetofswamps,pools,sinkholes,orothersurfacecollectionsofwaterunlesssuchquiescentwatersurfacescanbesubjectedtomosquitocontrolmeasures.Thecampshallbelocatedsothedrainagefromandthroughthecampwillnotendangeranydomesticorpublicwatersupply.Allsitesshallbegraded,ditched,andrenderedfreefromdepressionsinwhichwatermaybecomeanuisance.(a)(2)Allsitesshallbeadequateinsizetopreventovercrowdingofnecessarystructures.Theprincipalcampareainwhichfoodispreparedandservedandwheresleepingquartersarelocatedshallbeatleast500feetfromanyareainwhichlivestockiskept.(a)(3)Thegroundsandopenareassurroundingthesheltersshallbemaintainedinacleanandsanitaryconditionfreefromrubbish,debris,wastepaper,garbage,orotherrefuse.(a)Site(a)(1)Inactive,stagnantwaterwhichwouldnotordinarilydryoutduringnormalseasonalweatherisnotpermittedwithintheperimeterofthecampsite.Standingwaterwithin200feetofthecampperimetershouldbecheckedformosquitolarvae.TheASHInspectorshallcheckanystandingwaterinthecampareaforpresenceofmosquitolarvae.(a)(2)Livestockfeedingorquarteringfacilitiesmustbeatleast500feetfromfoodpreparationandsleepingfacilities.Apasturemaybecloserifitdoesnotpresentahealthhazard.Poultryisconsideredtobelivestock.(b)Shelter(b)(1)Everyshelterinthecampshallbeconstructedinamannerwhichwillprovideprotectionagainsttheelements.(b)(2)Eachroomusedforsleepingpurposesshallcontainatleast50squarefeetoffloorspaceforeachoccupant.Atleasta7-footceilingshallbeprovided.(b)Shelter(b)(2)Theterm“eachoccupant”shallincludeanyoccupantsover1yearofage.Inroomsusedforsleepingpurposesonly,the50squarefeetoffloorspaceshallincludeanyclosetsintheroom.Aroomisconsidereddesignated“forsleepingpurposesonly”whenithas4floor-to-ceilingwalls,atleastonePage1of14Page2of14STANDARD–29CFR1910.142...INTERPRETATION–29CFR1910.142...entrance/exitdooropeningandcontainsoneormorebed(s).Theprimarypurposeofsucharoomistoprovideanareaforworkerstosleepandtheareaisnotusedforcookingorasacommonlivingarea.Foranymulti-purposeroomwhereworkerscook,liveandsleep,100squarefeetoffloorspaceisrequiredforeachoccupantinaccordancewith1910.142(b)(9).Incalculatingthe100squarefeetoffloorspace,allareasoftheroomshallbeincluded(e.g.,kitchen,livingroom,diningroom).Whereceilingsareslopeddownwardfrom7feetormore,atleastone-halfthefloorareacountedtowardsquarefootagerequirementsshallhaveaminimumceilingheightof7feet.Nofloorspacewheretheceilingheightislessthan5feetshallbecountedtowardminimumrequirements.Inmanufacturedhousingwhichmeetsallotherstandards,suchasmobilehomes,aminimumceilingheightof6½feetisacceptable.Ceilingheightsbetween6½and7feetaregenerallyconsideredacceptable,buttheseconditionsmustbenotedontheinspectionreport.Proposedcitationsforceilingheightsbetween6½and7feetmustbeaccompaniedbythoroughdocumentationofthehazard.AllroomareasneedtobemeasuredbyanASHInspector.Toascertainifthespaceprovidedisadequateforthenumberofoccupants,usethefollowingcalculations:1)Foreachroomdesignatedfor“sleepingpurposesonly,”calculatethetotalnumberofsquarefeetanddivideby50t...
